On September 17th, the US International Trade Commission (ITC) announced that it has launched a patent infringement investigation into certain electronic devices equipped with specific audio technology. The survey targets include Samsung Electronics and its US subsidiaries, Apple, and Google.

This investigation stems from a complaint filed by BoomCloud 360, a California based audio technology company, in August. Specifically, investigation number 337-TA-1521 was initiated by BoomCloud 360, an audio technology company based in California, USA. The company claims that the products of these three companies infringe upon three of its held US patents, violate Section 337 of the 1930 Tariff Act, and requests the ITC to issue limited exclusion orders and restraining orders to prohibit the import and sale of these products in the United States.

However, ITC clarified that initiating this investigation (337-TA-1521) does not imply that it has made any decision on the substantive issues of this case. The Chief Administrative Law Judge of the United States International Trade Commission will assign this case to an Administrative Law Judge (ALJ) of the Commission, who will arrange and conduct an evidence hearing. The administrative law judge will make a preliminary ruling on whether there has been a violation of Article 337; This preliminary ruling will be subject to review by the United States International Trade Commission.

Samsung, Apple, and Google should respond to the complaint within 20 days after receiving the investigation notice.
